These terms and conditions, hereafter the “Terms”, regulates the agreement between you, the client, hereafter the “Client”, and WebLegal.ca, a website operated in Canada, including its directors, its agents, its employees and its contractors, hereafter “WebLegal.ca.”<\/p>\n
No fees already paid to the governments, federal or provincials, or to other agencies who receive payments on behalf of the governments can be refunded regardless of the situation. If a Client cancels an order, the Client will only be eligible to a refund of the governmental fees which have not already been paid to the governments or its agents.<\/p>\n
All fees and monies paid out by the Client to WebLegal.ca are deemed completely earned once the order has been submitted. No refund is possible once the Client has submitted the order.<\/p>\n
WebLegal.ca is not a law firm, and does not act as lawyers, legal nor accounting professionals. WebLegal.ca does not offer legal services, legal advices or legal opinions.<\/p>\n
WebLegal.ca strongly recommends that you meet with a lawyer or a professional shall you need legal advices.<\/p>\n
The Client agrees to provide truthful and accurate information to WebLegal.ca in using all of the services provided by WebLegal.ca. It is the responsibility of the Client to ensure that all the information provided is accurate and abides to the governmental rules and regulations.<\/p>\n
The Client agrees not to provide any false identity or identities. The Client or his agents declare that they are 18 years old or older and possess the authority to accept these Terms.<\/p>\n
The Client agrees not to use the services provided by WebLegal.ca for illegal purposes or to mislead WebLegal.ca or any governmental or municipal entities.<\/p>\n
WebLegal.ca agrees to respect the clauses of these Terms and to provide the services published on its website in return of the published fees in accordance to the clauses of these Terms.<\/p>\n
All search results are provided to WebLegal.ca by the Federal and\/or Provincials governments. Consequently, WebLegal.ca can not guarantee that the search results are correct. WebLegal.ca acts as a messenger of the information. WebLegal.ca can not be held liable for the accuracy of the search results.<\/p>\n
In the event that the name reservation or registration of the name chosen by the Client is disputed, the Client agrees not to hold WebLegal.ca liable and agrees to indemnify and save harmless WebLegal.ca from any liability, loss, damage or expense, including assessable legal fees. The Client understands and accepts that the registration or reservation of his name does not constitute a safeguard against possible objections to the registration, reservation or use of this name.<\/p>\n
When using the services of WebLegal.ca, the Client acts as his own agent. By providing its services to the Client, WebLegal.ca does not provide advices nor legal or professional services. Furthermore, WebLegal.ca does not make any representation, specifically or implicitly, as to the legal or other consequence that could arise in using its forms and\/or services. All the documentation provided by WebLegal.ca are templates that may or may not apply for the particular situation of the Client. It is the responsibility of the Client to decide if the documentation provided applies to his situation.<\/p>\n
The Client agrees to pay to WebLegal.ca all applicable fees for any service ordered. A fee of 60$ will apply for any chargeback in addition of all monies due for services rendered and fee paid to the governments.<\/p>\n
In the event that WebLegal.ca makes a mistake in the treatment of the Client’s order, WebLegal.ca will make all reasonable efforts to fix the problem and correct all documents and paperwork. Alternatively, WebLegal.ca reserves the right to refund the service(s) fees, at its sole discretion.<\/p>\n
The Client accepts that at any time WebLegal.ca may change the clauses of these Terms as well as the services they cover.<\/p>\n
The Client agrees that the responsibility of WebLegal.ca and any action by the Client, in regards to services rendered pursuant to these Terms or to the default of respecting a clause of these Terms, are limited to the amount that the Client paid for these services. WebLegal.ca can not be held liable, amongst others, for any direct, indirect, incidental, special or consequential damages (including the loss of profits, the loss of data, or the loss of use) caused by the use or the impossibility to use the services provided by WebLegal.ca, or for the costs to use the replacement services. WebLegal.ca is not responsible for any loss or any damage resulting, amongst others, from delays or interruption of access, bad or no delivery of data, act of God, mistakes and\/or omissions in information or services rendered in regards to these Terms, interruption of the Internet Service and\/or of the email service of the Client. These limitations ARE NOT exhaustive.<\/p>\n
The Client agrees to defend, indemnify and to not hold WebLegal.ca liable against any claims, damages, loss or expense, including, amongst others, the reasonable fees and costs for legal representation, that are in any way connected with the access and\/or use by the Client of the website, products and services of WebLegal.ca.<\/p>\n
WebLegal.ca will not be responsible of the corporate maintenance on behalf of the Client. The Client is solely responsible to ensure that he respects his governmental, municipal or other corporate obligations.<\/p>\n
The Client agrees that if, for any reasons, one of the clause of these Terms is deemed invalid or non enforceable, this clause will be deemed modified to be valid and enforceable in regards to the law and to reflect as closely as possible the true original intentions of the parties, and the other clauses of these Terms will remain in effect.<\/p>\n
The act by WebLegal.ca of not requiring the respect of one of the clause of these Terms by the Client or the act by WebLegal.ca to waive its rights following the default by the Client to respect a clause of these Terms does not revoke the right of WebLegal.ca to request the execution of the clause in question or to exercise its rights in the future, and does not render that clause inapplicable.<\/p>\n
The Client agrees that these Terms constitute the complete and exclusive contract between the Client and WebLegal.ca in regards to its object and replace any other preceding or concurrent agreement, written or verbal, in regards to the object of these Terms. These Terms nullify any other contract or arrangement, regardless if these arrangements are in the form of customs, policies, practices or precedents.<\/p>\n
These Terms are regulated by the laws of the province of Quebec, and will be interpreted and applied in accordance with these laws.<\/p>\n
All action resulting from these Terms will fall under the jurisdiction of the Quebec courts, in the district of Montreal, in the Province of Quebec in Canada.<\/p>\n
The client waives its rights to file an action in any other territory and district.<\/p>\n
WebLegal.ca reserves the right to cancel its services at all time and without prior notice.<\/p>\n
These Terms between the Client and WebLegal.ca does not constitute a partnership, nor a joint venture, nor a franchise, nor a employer employee relationship.<\/p>\n
These Terms between the Client and WebLegal.ca does not constitute a contract of legal services. <\/p>\n
The Client agrees that WebLegal.ca might obtain and exchange personal information as required by WebLegal.ca to execute the order of the Client. The Client agrees that this information be treated in accordance to the Privacy Policy of WebLegal.ca.<\/p>\n
The Client hereby declares having read and understood the Terms, and accepts all its clauses. The Client does not rely on any representation, warranty or declaration other than those present in these Terms. By using the services of WebLegal.ca, the Client automatically accepts the clauses of these Terms.
